Special Note
This agreement stipulates the rights and obligations between AirsTalk and users regarding the "AirsTalk" software service (including AirsTalk and AirsTalk Express, hereinafter referred to as "the Service"). "User" refers to individuals who download, install, register, log in, and use (hereinafter collectively referred to as "use") this service. Global AirsTalk Co., Ltd. (hereinafter referred to as "AirsTalk") hereby specifically reminds you (the user) to carefully read this User Agreement (hereinafter referred to as "the Agreement") before registering as a user, to ensure that you fully understand the terms of this agreement. Please read and fully understand this agreement carefully, especially the clauses involving exemption or limitation of liability, rights licensing and information usage, consent to open and use special individual services, applicable laws, and dispute resolution. Important content such as exemption or limitation of liability clauses will be highlighted in bold to draw the user's attention, and you should focus on reading them. If you do not agree to this agreement, this will prevent AirsTalk from providing you with complete products and services. You may also choose to stop using them. If you voluntarily choose to agree to or use AirsTalk software and related services, it will be deemed that you have fully understood this agreement and agree to be bound by this agreement and other agreements and rules related to AirsTalk software and related services (including but not limited to the AirsTalk Privacy Policy) as a party to this agreement.
In order to provide users with better services or due to changes in national laws and regulations, policy adjustments, technical conditions, product functions, etc., this agreement may be revised and updated by AirsTalk in a timely manner. The revised content shall constitute an integral part of this agreement. After the update of this agreement, AirsTalk will remind users of the updated content through official website announcements or other appropriate means, so that users can timely understand the latest version of this agreement. Users can also view the terms of the latest version of the agreement on the homepage of the website or the software settings page. If users continue to use the "AirsTalk" software and related services, it indicates that they have agreed to accept the revised content of this agreement.
Please fully understand and agree that this platform prohibits users under the age of 18 from registering and using related services. If you are under 18 years old, you will not be able to register for this product. For the purposes of user management and protection of minors, in accordance with relevant regulations, we will identify minors based on mechanisms related to the protection of minors and assess your behavior. If the platform determines that your account poses a risk of being used by minors, we will provide you with a youth protection service mode. The specific content and restrictions are subject to the actual display on the youth mode page.
1. Account registration
1. Users need to register an "AirsTalk" account before using this service. The "AirsTalk" account should be registered with a mobile phone number. Users are advised to use a mobile phone number that has not been bound to an "AirsTalk" account, and a mobile phone number that has not been banned by AirsTalk according to this agreement to register the "AirsTalk" account. AirsTalk may change the way of account registration and binding according to user needs or product requirements.
"AirsTalk" is a location-based mobile social networking product. Users can authorize AirsTalk to disclose and use their location information when registering.
3. In view of the binding registration method for the "AirsTalk" account, the user agrees that AirsTalk will use the mobile phone number provided by the user and/or automatically extract the user's mobile phone number and mobile device identification code for registration purposes. The user agrees to grant authorization to the operator, authorizing the operator to automatically extract the user's mobile phone number for authentication and use in the registration of the "AirsTalk" account. The user guarantees compliance with the operator's relevant service terms (click to view service terms). If the operator successfully authenticates the user's mobile phone number, the user's registration is complete. If the user does not agree to the operator's authorization and/or service terms, or if the user's mobile phone number authentication fails, the user can manually modify the mobile phone number extracted by the operator and register and log in using a verification code.
4. The user understands and promises that the account set up by the user shall not violate national laws and regulations and AirsTalk's relevant rules. The user's account name, avatar, profile, and other registration information as well as other personal information shall not contain illegal or harmful information. Without the permission of others, the user shall not open an account in the name of others (including but not limited to using others' names, titles, avatars, or adopting other methods that are sufficient to cause confusion) or maliciously register an AirsTalk account (including but not limited to frequent registration, bulk registration of accounts, etc.). The user shall comply with relevant laws and regulations during the registration and use of the account, and shall not engage in any behavior that infringes on national interests, harms the legitimate rights and interests of other citizens, or is detrimental to social morality and customs. AirsTalk has the right to review the registration information submitted by the user.
5. When users register and use this service, AirsTalk needs to collect personal information that can identify the user's identity so that AirsTalk can contact the user when necessary or provide a better user experience. The information collected by AirsTalk includes but is not limited to the user's name, gender, age, date of birth, ID number, address, school information, company information, industry, hobbies, frequent places, and personal description; the use of this information by AirsTalk will be subject to the constraints of Article 3 on the protection of user personal privacy information.
6. If your registration information changes, you should promptly make the necessary updates. When you apply for cancellation of your mobile phone number or when your mobile phone number is cancelled for other reasons, please update the mobile phone number information bound to your AirsTalk account in a timely manner. AirsTalk will not be held responsible for any user data leakage or other personal rights and interests damage caused by your failure to promptly update the mobile phone number information bound to your AirsTalk account. If you need to change the mobile phone number provided during registration, you can go to [More - Settings icon in the top right corner - Account and Security - Mobile Phone Binding - Change Bound Mobile Phone Number] to enter a new mobile phone number and SMS verification code to complete the change.
II. Service Content
1. The specific content of this service is provided by AirsTalk based on actual circumstances, including but not limited to enabling authorized users to engage in instant messaging, add friends, join groups, follow others, post comments, participate in online live broadcasts, and interact and communicate through their accounts. To better enhance user experience and service, AirsTalk will occasionally change the services it provides (including but not limited to software modifications, upgrades, functional enhancements, development of new services, software replacements, etc.); users will receive notifications from AirsTalk regarding service changes (including but not limited to system prompts, announcements, in-site messages, etc.). Users have the right to choose whether to accept the updated version; if users choose not to update, some functions of this service will be restricted or cannot be used normally.
2. AirsTalk grants the user a personal, revocable, non-transferable, non-exclusive, and non-commercial legal right to use AirsTalk software and related services. All other rights not expressly granted in this agreement remain reserved by AirsTalk. The user must obtain written permission from AirsTalk before exercising such rights. Meanwhile, if AirsTalk does not exercise any of the aforementioned rights, it does not constitute a waiver of such rights.
3. The services provided by AirsTalk include both free and paid services. Users can purchase paid services by paying a certain amount of RMB through WeChat, Alipay, or other payment methods provided by the "AirsTalk" platform to purchase "AirsTalk" platform's virtual currency - AirsTalk coins. Then, according to the tariff standards published by AirsTalk, users can use AirsTalk coins to purchase the paid services they wish to use, thereby obtaining access to the paid services. For paid services, AirsTalk will provide users with clear prompts before they use them. Only after users confirm their agreement to pay according to the aforementioned payment method and complete the payment, can they use such paid services. The completion of the payment is subject to the confirmation notification generated by the bank or third-party payment platform indicating "payment completed".
III. Protection of User Personal Information
1. During the registration of an account or the use of this service, users may need to fill in and submit some necessary personal information, such as identity information required to be filled in according to laws, regulations, and normative regulatory documents (hereinafter referred to as "laws and regulations"). If the information filled in and submitted by the user is incomplete or does not comply with the provisions of laws and regulations, the user may be unable to use this service or may be restricted in the use of this service.
2. User personal information includes: 1) User personal information provided by the user themselves (such as personal information filled in during registration, such as mobile phone number, and geographic location information when the user enables location function and uses the service); 2) User personal information shared by other parties; 3) User personal information legally collected by AirsTalk for providing services (such as device or software information automatically collected by the system when using the service, browsing history information, time information, and other information). Personal information refers to various information recorded electronically or in other ways that can identify a specific natural person's identity or reflect a specific natural person's activities, either alone or in combination with other information. The user acknowledges, understands, and agrees that when using AirsTalk's products and/or services, AirsTalk will process and protect the user's personal information in accordance with the "AirsTalk Privacy Policy" published on the platform. Therefore, it is hoped that the user will carefully read and fully understand the full text of the "AirsTalk Privacy Policy", and when necessary, follow the guidelines of the "AirsTalk Privacy Policy" to make choices that the user deems appropriate.
3. AirsTalk attaches great importance to the protection of personal information. AirsTalk will take technical measures and other necessary measures to ensure the security of users' personal information and prevent the leakage, destruction, or loss of users' personal information collected in this service. In the event of the aforementioned situation or when AirsTalk discovers the possibility of the aforementioned situation, AirsTalk will promptly take remedial measures and inform users. If users discover the aforementioned situation, they are also required to immediately contact AirsTalk.
4. AirsTalk will not disclose or reveal users' personal information to any third party without their consent. However, the following specific situations are exceptions:
(1) AirsTalk provides users' personal information in accordance with legal regulations or directives from authorized institutions;
(2) Any leakage of personal information caused by the user disclosing or sharing their registered account and password with others, or any leakage of personal information not caused by AirsTalk;
(3) Users disclose their personal information to third parties on their own;
(4) The user and AirsTalk, as well as the cooperating entity, have reached an agreement regarding the use and disclosure of the user's personal information, and AirsTalk hereby discloses the user's personal information to the cooperating entity;
(5) Any leakage of user personal information due to hacker attacks, computer virus intrusions, and other force majeure events;
(6) The user's personal information has been processed to the extent that it cannot identify a specific individual and cannot be restored.
5. The user agrees that AirsTalk may use the user's personal information in the following matters:
(1) AirsTalk promptly sends important notifications to users, such as software updates and changes to the terms of this agreement;
(2) AirsTalk conducts internal audits, data analysis, and research to improve its products, services, and communication with users;
(3) According to the agreement, AirsTalk manages, reviews, and takes measures to handle user information;
(4) Other matters stipulated by applicable laws and regulations.
Apart from the aforementioned matters, AirsTalk will not utilize users' personal information for any other purposes without their prior consent.
6. AirsTalk places great emphasis on the protection of minors. No one under the age of 18 is allowed to register an account or use this service.
7. AirsTalk guarantees that it will collect, use, or disclose user personal information under the principles of legality, propriety, and necessity, and will not collect user personal information unrelated to the services provided.
8. AirsTalk places great emphasis on protecting users' personal information and privacy, and has formulated the "AirsTalk Privacy Policy" (click to view). Users should use AirsTalk's products and/or services after carefully reading and fully understanding the "AirsTalk Privacy Policy". If users do not agree with the content of the policy, it may result in the inability to operate AirsTalk's products and/or services normally, or the inability to achieve the service effects intended by AirsTalk. Users can also view the details through "About AirsTalk" in the "Settings" page. AirsTalk hopes to clearly introduce to users the handling of their personal information through the "AirsTalk Privacy Policy", so it is recommended that users read the "AirsTalk Privacy Policy" in its entirety to help them better protect their privacy rights.
IV. Content Norms
1. The content referred to in this clause refers to any content created, uploaded, copied, published, or disseminated by users during the use of this service, including but not limited to registration information and authentication materials such as account avatars, names, and user descriptions, or text, voice, images, videos, graphic and text messages sent, replied to, or automatically replied to, as well as related linked pages, and other content generated by using the account or this service.
2. Users shall not use their "AirsTalk" accounts or this service to create, upload, copy, publish, or disseminate any content prohibited by the following laws, regulations, and policies:
(1) Opposing the basic principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(3) Damaging national honor and interests;
(4) Distorting, vilifying, desecrating, or denying the deeds and spirit of heroes and martyrs, and infringing upon the names, portraits, reputations, and honors of heroes and martyrs through insults, defamation, or other means;
(5) Advocating terrorism or extremism, or inciting the implementation of terrorist or extremist activities;
(6) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;
(7) Undermining national religious policies, promoting cults and feudal superstitions;
(8) Spreading rumors and disrupting economic and social order;
(9) Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crimes;
(10) Insulting or defaming others, infringing upon others' reputation, privacy, and other legitimate rights and interests;
(11) Inciting illegal assemblies, associations, processions, demonstrations, or gathering crowds to disturb social order;
(12) Engaging in activities under the guise of an illegal non-governmental organization;
(13) Failing to adhere to the "seven bottom lines" requirements, namely, the bottom line of laws and regulations, the bottom line of the socialist system, the bottom line of national interests, the bottom line of citizens' legitimate rights and interests, the bottom line of social public order, the bottom line of moral customs, and the bottom line of information authenticity;
(14) Information containing other content prohibited by laws, administrative regulations, and policies.
3. Users shall not use their "AirsTalk" accounts or this service to create, upload, copy, post, or disseminate any content that interferes with the normal operation of "AirsTalk", infringes upon the legitimate rights and interests of other users or third parties, or has a negative impact on the online ecosystem, such as:
(1) Using exaggerated titles, with content that significantly does not match the title;
(2) Hyping up rumors, scandals, misdeeds, etc;
(3) Making inappropriate comments on natural disasters, major accidents, and other calamities;
(4) Those with sexual implications, sexual provocations, or other content that easily leads to sexual associations;
(5) Showing bloody, thrilling, cruel, or other content that makes people physically and mentally uncomfortable;
(6) Inciting discrimination among people or regional discrimination;
(7) Promoting vulgar, mediocre, and kitsch content;
(8) It may lead minors to imitate unsafe behaviors and violate social ethics, and induce minors to develop bad habits, etc;
(9) Containing abusive, intimidating, or threatening content;
(10) Contains harassment, spam, malicious information, or deceptive information;
(11) Infringing upon others' personal information or data;
(12) Infringing upon the legitimate rights of others, such as the right to one's portrait, intellectual property rights, and trade secrets;
(13) Information that contains content that interferes with the normal operation of this service and infringes upon the legitimate rights and interests of other users or third parties, thereby causing adverse impacts on the online ecosystem.
V. Usage Rules
1. Any content transmitted or posted by users in or through this service does not reflect or represent, and shall not be deemed to reflect or represent, the views, positions, or policies of AirsTalk, for which AirsTalk shall not bear any responsibility.
2. Users shall not use the "AirsTalk" account or this service to engage in the following behaviors:
(1) Submitting or publishing false information, or using others' avatars or profiles, impersonating or exploiting others' names;
(2) Forcing or inducing other users to follow, click on linked pages, or share information;
(3) Fabricating facts or concealing the truth to mislead or deceive others;
(4) Using technology or other means to engage in batch registration, manipulate fake accounts, engage in illegal account trading, forge or fabricate business data information, and other activities that disrupt the platform's operational order;
(5) Using the "AirsTalk" account or this service to engage in any illegal or criminal activities;
(6) Creating, publishing, operating, or disseminating methods and tools related to the aforementioned behaviors, regardless of whether these actions are for commercial purposes;
(7) Other behaviors that violate laws and regulations, infringe upon the legitimate rights and interests of other users, disrupt the normal operation of "AirsTalk", or are not expressly authorized by AirsTalk.
3. Users must be fully responsible for the authenticity, legality, harmlessness, accuracy, and validity of the information transmitted using their "AirsTalk" account or through this service. Any legal responsibility related to the information disseminated by the user shall be borne by the user themselves, and has nothing to do with AirsTalk. If any damage is caused to AirsTalk or a third party as a result, the user shall compensate according to law.
4. The services provided by AirsTalk may include advertisements, and users agree to display advertisements provided by AirsTalk and third-party suppliers and partners during use. Except as expressly provided by laws and regulations, users shall be responsible for transactions conducted based on such advertisement information, and AirsTalk shall not be liable for any loss or damage suffered by users due to transactions conducted based on such advertisement information or content provided by the aforementioned advertisers.
5. Unless otherwise permitted in writing by AirsTalk, users are not allowed to engage in any of the following behaviors:
(1) Delete copyright information from software and its copies;
(2) Reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code of software;
(3) Use, rent, lend, copy, modify, link, repost, compile, publish, publish, and establish mirror sites for AirsTalk's intellectual property content;
(4) Copy, modify, add, delete, mount, or create any derivative works of software or data released into the memory of any terminal during software operation, interaction data between client and server during software operation, and system data necessary for software operation, including but not limited to using plugins, plug-ins, or third-party tools/services not authorized by AirsTalk to access software and related systems;
(5) By modifying or forging instructions and data during software operation, adding, deleting, or altering the functionality or performance of the software, or operating or disseminating software or methods used for the aforementioned purposes to the public, regardless of whether these actions are for commercial purposes;
(6) Log in or use AirsTalk software and services, or create, publish, and disseminate third-party software, plugins, plugins, and systems that are not developed or authorized by AirsTalk.
6. The services provided by AirsTalk may include AI intelligence related functions. Due to technical limitations or ethical issues, AirsTalk is very concerned about the possibility of AI intelligence technology being abused. Users should be fully aware of and agree to the following during use:
(1) AI intelligent services are artificial intelligence services provided by AirsTalk to users based on big model technology. Users can refer to the AirsTalkAI Intelligent Service Agreement to learn about AI intelligent services.
(2) Given the nature of machine learning and artificial intelligence, model generated content may provide incorrect or false outputs. AirsTalk does not guarantee the authenticity, accuracy, or reliability of the generated content. The generated content does not represent AirsTalk's views or any professional advice, and should not be used as a basis for further actions or inactions by users. The generated content is only for entertainment purposes within the "AirsTalk" app. Users are advised not to refer to, imitate, or execute it in real life. Users should make their own judgments on the generated content during use and bear all risks arising from the use of such content (including reliance on its correctness, completeness, or legality). AirsTalk is not responsible for this.
(3) AirsTalk attaches great importance to the content security of its models and will strive to take reasonable security measures to filter out any inappropriate/harmful content that may be generated, but it cannot completely rule out the possibility of errors still occurring. If the user encounters such a situation, please feel free to provide feedback to AirsTalk through the contact information disclosed in Article 8 of this agreement.
(4) Users' behavior and input content when using AI intelligent services should comply with the relevant requirements of laws, regulations, and normative documents, and must not infringe on the legitimate rights and interests of any third party. Users are independently responsible for their behavior and input content during the use of intelligent services.
(5) Special reminder: Users are not allowed to use new technologies and applications based on deep learning to create, publish, or disseminate false information. When users publish or disseminate information generated by new technologies and applications based on deep learning, they should prominently identify or prompt it, and should not mislead or confuse others. Users should not delete or modify the labels added to this software based on new technologies and applications such as deep learning and virtual reality in a misleading manner.
6、 Virtual currency
1. AirsTalk will issue a virtual currency, AirsTalk Coin, on the AirsTalk platform. AirsTalk coins can be used to purchase value-added services on the AirsTalk platform, including but not limited to virtual gift services and membership services. They cannot be used for any other purposes. The prices of these value-added services are all in AirsTalk coins, and the specific price information will be determined by AirsTalk and displayed on the relevant service page.
2. The exchange rate between AirsTalk Coin and RMB varies depending on the user's purchasing channel. The specific exchange rate is displayed on the service page of the relevant channel where the user purchases AirsTalk Coin. AirsTalk reserves the right to change the above exchange rate at any time based on operational conditions, and it will be displayed on the user's purchase of AirsTalk coin related channel service page.
3. By default, users have opened an AirsTalk coin account, which allows them to purchase (hereinafter referred to as "recharge") and consume AirsTalk coins. Users can check their AirsTalk coin balance, purchase history, and consumption history on the wallet page. AirsTalk coin related information will not be considered public information.
4. Users can recharge AirsTalk currency accounts through WeChat, Alipay or other recharge channels provided by the "AirsTalk" platform. After purchasing related paid services with AirsTalk coins, users can gift the related paid services to other users. The user confirms that they will not recharge illegally or use non platform designated recharge channels. If the user illegally recharges/purchases AirsTalk coins using non AirsTalk approved recharge channels, AirsTalk does not guarantee the smooth or correct completion of the recharge. If this causes damage to the user's rights, AirsTalk will not make any compensation or indemnification. AirsTalk also reserves the right to suspend or terminate part or all of the user's AirsTalk account permissions, freeze the user's account balance, temporarily or permanently ban the user's account, and/or prohibit the user from using various recharge services at any time.
5. The user confirms that they have carefully confirmed their account and carefully selected and/or entered the recharge account, recharge amount, and other related operation options before recharging. If the user enters the wrong account, recharge amount, improper operation, or does not understand the recharge billing method and causes damage to their rights and interests, such as recharging the wrong account, recharge amount, or selecting the wrong recharge type, the user shall bear the losses incurred, and AirsTalk will not make any compensation or indemnification.
6. The user agrees and confirms that AirsTalk coin is a digital product and is not subject to the constraints of the seven day no reason return clause in the Local Consumer Rights Protection Law due to its special attributes. Once the purchase is successful, the AirsTalk coins in the user's account can be freely used by the user in this service, but AirsTalk will not provide any AirsTalk coin refund or reverse exchange services. Please purchase the corresponding amount of AirsTalk coins according to your actual needs.
7. If AirsTalk discovers a processing error caused by system failure or any other reason, whether it is beneficial to AirsTalk or the user, AirsTalk has the right to correct the error. If this measure results in the actual amount of AirsTalk coins received by the user being less than the AirsTalk coins that the user should receive, AirsTalk will promptly make up the difference to the user's account after confirming the processing error. If the error results in the user receiving more AirsTalk coins than they should have received, AirsTalk has the right to deduct the difference directly from the user's account, regardless of the nature and cause of the error.
8. The user confirms that AirsTalk Coin can only be used to purchase various value-added services on the "AirsTalk" platform. Under no circumstances shall AirsTalk Coin transactions be conducted privately in violation of the above agreement. If AirsTalk violates the above agreement and causes any losses to the user or third parties, AirsTalk shall not be held responsible. If AirsTalk has reason to suspect that the user's AirsTalk Coin account or usage is cheating or abnormal, AirsTalk will refuse the user to use AirsTalk Coin for payment until relevant ban measures are taken in accordance with this agreement.
9. AirsTalk has the right to set or modify relevant matters related to transactions from time to time based on considerations of transaction security, operational strategies, industry practices, etc., including but not limited to transaction limits, transaction frequency, etc.
10. In order to better provide product services to users, the platform will collect and record data generated by users recharging and purchasing AirsTalk coins, and using AirsTalk coins in this service, including but not limited to user recharging, purchasing virtual gifts and other products or services, red packets and other behavior information generated by using AirsTalk coins in this service, as well as user account information, unclaimed gifts in backpacks, AirsTalk coin balance and other account information.
11. Any losses or liabilities arising from AirsTalk's inability to provide AirsTalk coin purchase services or any errors in providing AirsTalk coin purchase services due to the user's own reasons shall be borne by the user, and AirsTalk shall not be held responsible, including but not limited to:
(1) Due to the loss, suspension, or freezing of the user's AirsTalk account;
(2) Property damage caused by users sharing their passwords with others;
(3) Any losses or liabilities caused by the third-party payment institution account bound by the user;
(4) Property losses caused by intentional or gross negligence or violation of laws and regulations by other users.
12. AirsTalk reserves the right to temporarily or permanently ban the user's account in the event of any suspected criminal, illegal or irregular behavior, violation of socialist ethics, violation of this agreement or other management regulations of this service when using the recharge service. After the account is banned until it is unlocked (if any), the remaining AirsTalk coins on the user's account will be frozen or deducted in full, and cannot be used to purchase any products or services provided by this service. AirsTalk will not refund the cash value of the user's AirsTalk coin purchase, nor will it provide any compensation.
13. The user confirms and agrees that if the user voluntarily cancels the account, the AirsTalk coins, virtual gifts, game coins, and membership benefits that the user has recharged and received will be automatically forfeited. AirsTalk will not refund the corresponding cash value nor provide any compensation.
14. The user guarantees that the funds used for AirsTalk coin recharge are the user's legitimate income, and the user has full rights to use them in accordance with the provisions of this agreement. Any disputes or controversies arising from the user's violation of this clause shall be resolved by the user themselves, and the user shall bear all responsibilities and legal consequences arising therefrom. At the same time, if AirsTalk discovers (including but not limited to actively discovering, receiving third-party complaints or notifications from authorities) the above-mentioned reasons, it has the right to unilaterally decide to restrict users from using all or part of AirsTalk coins to recharge, suspend or terminate recharge services to users, or take further management measures on users' accounts; If any losses are caused to AirsTalk as a result, users should be fully compensated. At the same time, AirsTalk has the right to retain relevant information and report to relevant law enforcement/judicial agencies and regulatory authorities.
15. If according to tax related laws and regulations, AirsTalk needs to withhold and pay personal income tax for users, AirsTalk will declare and withhold relevant taxes for users in the month when they generate income.
7、 Account management
1. The ownership of the "AirsTalk" account belongs to AirsTalk. After completing the application and registration procedures, users only obtain the right to use the "AirsTalk" account, which belongs only to the initial applicant and registrant. The initial applicant for registration shall not gift, borrow, rent, transfer or sell the "AirsTalk" account, or permit non initial applicants to use the "AirsTalk" account in any other way. Non initial applicants are not allowed to use the "AirsTalk" account through donation, inheritance, leasing, transfer, or any other means. If AirsTalk discovers or has reasonable grounds to believe that the user is not the initial registrant of the account, in order to ensure account security, AirsTalk has the right to immediately suspend or terminate services provided to the registered account, and has the right to permanently disable the account.
2. Users can query, change, delete, or cancel their personal information, registration information, and transfer content on the "AirsTalk" account through 1) viewing and editing their profile page, and 2) the "Account and Security" page in the "Settings" page. However, it should be noted that deleting relevant information will also delete the user's text and images stored in the system.
3. Users are responsible for ensuring the security of their registered account information and password. Improper management may result in account theft or password theft, and the responsibility shall be borne by the user themselves. Users are required to bear legal responsibility for their actions under the registered account and password. The user agrees not to use other users' accounts or passwords under any circumstances. When the user suspects that someone else is using their account or password, the user agrees to immediately notify AirsTalk.
4. The user shall comply with the terms of this agreement and use the service correctly and appropriately. If the user violates any of the terms of this agreement, AirsTalk has the right to suspend or terminate the service provided to the defaulting user's "AirsTalk" account in accordance with the agreement after notifying the user.
5. Users can access account cancellation services through the "Account and Security" page in the "Settings" section. AirsTalk will assist users in canceling their accounts after completing reasonable and necessary verifications of personal identity, security status, device information, infringement complaints, etc., and delete all information related to their accounts according to user requirements, except as otherwise provided by laws and regulations. The user confirms that account cancellation is an irreversible operation, and the user should backup the information and data related to the AirsTalk account by themselves. All services related to the AirsTalk account have been properly handled before the user confirms the operation. The user's confirmation and agreement to cancel the account does not mean that the account behavior and related responsibilities before the cancellation of this AirsTalk account are exempted or reduced. If during the cancellation period, the user's account is complained about by others, investigated by national authorities, or is in litigation or arbitration proceedings, AirsTalk has the right to terminate the user's account cancellation on its own.
8、 Risk bearing
1. The user understands and agrees that "AirsTalk" is only a platform for users to share, transmit, and obtain information. The user must be responsible for all actions under their registered account, including any content transmitted by the user and any consequences arising therefrom. Users should make their own judgments on the content of "AirsTalk" and this service, and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, completeness, or practicality of the content. AirsTalk cannot and will not be liable for any loss or damage caused by user behavior.
2. If the user discovers that anyone violates the provisions of this agreement or uses this service in any other inappropriate way, please immediately report or complain to AirsTalk. The reporting or complaint hotline is 028-63239000, and AirsTalk will handle it in accordance with the provisions of this agreement.
3. The user understands and agrees that AirsTalk reserves the right to unilaterally change, suspend, terminate or revoke all or part of the service content of this service due to business development needs.
9、 Intellectual Property Declaration
1. Except for the intellectual property rights related to advertising in this service, which are owned by the corresponding advertisers, the intellectual property rights of the content provided by AirsTalk in this service (including but not limited to web pages, text, images, audio, video, charts, etc.) belong to AirsTalk, except for the content that users have legally obtained intellectual property rights for before using this service.
2. Unless otherwise specified, the copyright, patent, and other intellectual property rights of the software relied upon by AirsTalk for providing this service belong to AirsTalk.
3. The graphics, text or their composition, as well as other AirsTalk logos and product/service names (collectively referred to as "AirsTalk logos") involved in this service, are the copyright or trademark of AirsTalk. Without prior written consent from AirsTalk, users shall not display or use the AirsTalk logo in any way, nor shall they indicate to others that they have the right to display, use, or otherwise handle the AirsTalk logo.
4. The above and any other intellectual property rights owned by AirsTalk or related advertisers in accordance with the law are protected by law. Without written permission from AirsTalk or related advertisers, users are not allowed to use or create related derivative works in any form.
5. The text, images, videos, audio, software, live content, performances, and other forms of content and information uploaded by users when using AirsTalk services are all original or legally authorized (including sub authorization) by users. The intellectual property rights of this content and information belong to the user or the original copyright owner, and the responsibility is borne by the user. The user's publication and upload behavior shall be deemed as authorization of AirsTalk. The user understands and agrees to grant AirsTalk and its affiliated companies a completely free, non exclusive, permanent, sublicensable and sublicensable right worldwide, including but not limited to: reproduction right, distribution right, rental right, exhibition right, performance right, screening right, broadcasting right, information network dissemination right, filming right, adaptation right, translation right, compilation right, and other copyright property rights and adjacent rights enjoyed by the copyright owner as stipulated in the Copyright Law. AirsTalk allows users to choose whether to use and how to use it, including but not limited to using and disseminating the aforementioned content and information on AirsTalk's service platforms, editing and using the aforementioned content and information again, and authorizing partners to use, edit, and broadcast it through AirsTalk. For the avoidance of doubt, the user understands and agrees that the rights granted above include the right and license to use, copy, and display the personal image, portrait, name, trademark, service mark, brand, name, logo, and company mark (if any) owned or licensed by the user and embedded in the content and information, as well as any other brand, marketing or promotional assets, materials, materials, etc.
10、 Legal responsibility
1. If AirsTalk discovers or receives reports or complaints from others that a user violates the provisions of this agreement, AirsTalk has the right to conduct compliance reviews of the data generated by the user on the platform (including but not limited to user information, dynamics, etc.), and impose measures on the violating account, including but not limited to warnings, refusal to publish, deletion of content, restriction of some or all functions of the account until the service is terminated, permanent closure of the account, etc., depending on the severity of the situation. AirsTalk shall not be responsible for any consequences caused by this, such as the user being unable to use the account and related services normally, unable to obtain assets or other rights in the user account. AirsTalk will notify the user of the handling results and has the right not to restore deleted content.
2. Users who have been banned for violating platform rules can submit appeals to AirsTalk on the relevant pages of the website. AirsTalk will review the appeals and make reasonable judgments on whether to change the punishment measures.
3. The user understands and agrees that AirsTalk has the right to impose penalties on any violation of relevant laws, regulations or provisions of this agreement based on reasonable judgment, take appropriate legal actions against any user who violates the law, and report relevant information to relevant departments in accordance with laws and regulations. The user shall bear all legal responsibilities arising therefrom.
4. The user understands and agrees that any claims, demands, or losses, including reasonable attorney fees, arising from or resulting from the user's breach of this agreement by any third party, the user shall compensate AirsTalk and its partner companies, affiliated companies, and hold them harmless.
5. AirsTalk respects and protects the legitimate rights and interests of users and others, including intellectual property, reputation, name, privacy, and more. If users discover any content on the platform that violates their legitimate rights and interests, they can notify AirsTalk through the complaint channels provided by the platform and provide corresponding evidence. AirsTalk will promptly handle user complaints in accordance with relevant laws and regulations. The user guarantees that the text, images, videos, audio, links, etc. uploaded during the use of this service do not infringe upon any third-party intellectual property, reputation, name, privacy, or other rights and legitimate interests. Otherwise, AirsTalk has the right to remove the suspected infringing content upon receipt of notice from the rights holder or relevant parties. Users should handle and bear all legal responsibilities that may arise from all claims made by third parties; If AirsTalk and its affiliates suffer losses (including but not limited to economic and reputational losses) due to the user's infringement behavior, the user should also fully compensate AirsTalk and its affiliates for all losses suffered.
6. If a user violates national laws and regulations, the provisions of this agreement, or other management regulations of the platform when using the services provided by AirsTalk, AirsTalk has the right to temporarily or permanently ban the user's account. After the account is banned until it is unlocked (if any), the remaining AirsTalk coins on the user's account will be frozen or deducted in full, and cannot be used to purchase any products or services provided by this service. AirsTalk will not refund the cash value of the user's AirsTalk coin purchase, nor will it provide any compensation.
11、 Force majeure and other exemption reasons
1. The user understands and confirms that during the use of this service, there may be risk factors such as force majeure that may cause interruption of this service. Force majeure refers to objective events that are unforeseeable, insurmountable, unavoidable, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, riots, and government actions. When the above situation occurs, AirsTalk will strive to cooperate with relevant units in a timely manner and carry out repairs. However, AirsTalk and its cooperating units are exempt from liability within the scope permitted by law for any losses caused to users or third parties as a result.
2. Like most Internet services, this service is affected by differences in factors including but not limited to user reasons, network service quality, social environment, etc., and may be harassed by various security issues, such as the harassment in real life caused by others using user information; Other software downloaded and installed by users or websites visited contain viruses such as Trojan horses, which threaten the security of users' computer information and data, and subsequently affect the normal use of this service. Users should enhance their awareness of information security and protection of user data, and pay attention to strengthening password protection to avoid losses and harassment.
3. The user understands and confirms that the service is at risk of service interruption or failure to meet user requirements due to force majeure, computer virus or hacker attacks, system instability, user location, user shutdown and any other technology, Internet, communication line reasons, etc. AirTalk will not be liable for any loss to the user or a third party caused thereby.
4. The user understands and confirms that AirsTalk shall not be liable for any losses incurred by the user or third parties as a result of the existence of any misleading, deceptive, threatening, defamatory, offensive, or illegal information from others, or anonymous or impersonated information that infringes on the rights of others, as well as any behavior accompanying such information during the use of this service.
5. The user understands and confirms that AirsTalk needs to regularly or irregularly inspect or maintain the "AirsTalk" platform or related equipment. If the service is interrupted within a reasonable time due to such circumstances, AirsTalk shall not be held responsible for this, but AirsTalk shall notify in advance.
6. AirsTalk has the right to handle illegal, irregular or breach of contract content in accordance with laws and regulations and the provisions of this agreement. This right does not constitute an obligation or commitment of AirsTalk, and AirsTalk cannot guarantee timely detection of illegal, irregular or breach of contract behavior or corresponding handling.
7. The user understands and confirms that AirsTalk shall not be liable for any quality defects or losses arising from the following products or services provided to the user:
(1) AirsTalk provides free services to users;
(2) Any product or service gifted to users by AirsTalk.
8. In no event shall AirsTalk be liable for any indirect, consequential, punitive, incidental, special or punitive damages, including loss of profits suffered by users as a result of their use of "AirsTalk" or this service (even if AirsTalk has been informed of the possibility of such losses). Despite any provisions to the contrary in this agreement, AirsTalk's full liability to the user shall not exceed the fees (if any) paid by the user to AirsTalk for the use of the services provided by AirsTalk, for any reason or in any way.
12、 Change, interruption, and termination of services
1. Given the unique nature of online services, users agree that AirsTalk has the right to change, interrupt, or terminate some or all of its services (including paid services) as appropriate. AirsTalk shall notify users of any changes, interruptions, or terminations of its services prior to such changes, interruptions, or terminations, and shall provide equivalent alternative services to affected users; If the user is unwilling to accept alternative services, if the user has already paid AirsTalk for AirsTalk coins, AirsTalk should deduct the corresponding AirsTalk coins based on the user's actual use of the service and return the remaining AirsTalk coins to the user's AirsTalk coin account.
2. If any of the following situations occur, AirsTalk has the right to change, interrupt or terminate the free or paid services provided to users without any liability to users or any third party:
(1) According to the law, users are required to submit truthful information, but the personal information provided by the user is untrue or inconsistent with the information provided at the time of registration without providing reasonable proof;
(2) The user violates relevant laws and regulations or the provisions of this agreement;
(3) According to laws and regulations or the requirements of authorized authorities;
(4) For safety reasons or other necessary circumstances.
13、 Other
1. AirsTalk solemnly reminds users to pay attention to the clauses in this agreement that exempt AirsTalk from liability and limit user rights. Users are advised to carefully read and consider the risks independently.
2. The validity, interpretation, and resolution of disputes of this agreement shall be governed by local laws. If any disputes or controversies arise between the user and AirsTalk, they should first be resolved through friendly negotiation. If negotiation fails, the user agrees to submit the dispute or controversy to the people's court with jurisdiction over AirsTalk's domicile.
3. Any provision of this agreement shall be invalid or unenforceable for any reason, and the remaining provisions shall remain valid and binding on both parties.
4. Due to the rapid development of the Internet, the terms listed in this agreement signed between the user and AirTalk may not fully list and cover all the rights and obligations of the user and AirTalk, and the existing agreement cannot guarantee that it will fully meet the needs of future development. Therefore, the "AirsTalk Privacy Policy", "AirsTalk Platform Code of Conduct", "AirsTalk Gift Service Terms", "AirsTalk Wallet Service Agreement", "AirsTalk Coin Recharge Agreement", "AirsTalk Membership Agreement", etc. are all supplementary agreements to this agreement, which are inseparable from this agreement and have the same legal effect. If the user uses AirsTalk platform services, it shall be deemed that the user agrees to the above supplementary agreement.
